AN ORDINANCE OF THE TOWN OF WILSON CREEK AMENDING MUNICIPAL CODE SECTION 13.04.045 ENTITLED “DISCONTINUANCE OF WATER SERVICE FOR LACK OF COMPLIANCE WITH LEGAL REQUIREMENTS”

NOW, THEREFORE, THE TOWN COUNCIL OF THE TOWN OF WILSON CREEK, WASHINGTON, HEREBY ORDAINS AS FOLLOWS:

            Section: 13.04.045     Discontinuance of Water Service for Lack of Compliance with

Legal Requirements

Section 1 – Amendment: Section 13.04.045 of the Wilson Creek Municipal Code entitled “Discontinuance of water service for lack of compliance with legal requirements” is hereby amended to provide as follows:

13.04.45 – Discontinuance of water service for lack of compliance with legal requirements.  Service to any property, landowner, or water user receiving its water supply from the town water supply system is contingent upon compliance with all legal requirements pertaining to such water service. Service may be discontinued to any premises, water user, or property owner for failure to comply with such requirements and discontinued service will not be re-established until the Town Council or their designee is satisfied that there has been compliance. Town water may be discontinued to any parcel of land within a residential zone and without a permitted and fully functional on-site sewage system if the parcel, landowner, or water user is in violation of any provision of the Town Municipal Code, including the Town Building Code, after at least five calendar days’ notice of violation and water shut off and opportunity to cure has been given by the Town to the violating landowner or water user.

Section 2 – Effective Date: This Ordinance shall be in full force and effect five (5) days after its passage and publication of its summary as provided by law.
